The agreement
These terms apply when you use Hospitally on the web at hospitally.app or in the Hospitally iPhone app. By creating an account or using the service you agree to them. If you use Hospitally for a hotel, you confirm that you're allowed to accept these terms for it, and "you" includes the hotel.
Our Privacy Policy explains how we handle personal information and is part of these terms.
Accounts
- Sign in with an email address you control, or with Google or Apple. Keep your sign-in details to yourself and tell us right away if you think someone else has used your account.
- One account is for one person. Don't share it among staff; invite each person instead.
- You're responsible for what happens under your account.
Hotels and roles
The person who creates a hotel is its general manager. The general manager invites staff, sets their roles, and controls the hotel's settings, including trusted networks and two-step verification. Staff see and change what their role allows. The hotel is responsible for who it invites and for removing people who leave.
Your data
The hotel owns its data: reservations, guest records, messages, floor plans and everything else it puts into Hospitally. You give us permission to host, process and display it only to provide and improve the service for you, and as described in our Privacy Policy.
You're responsible for having the right to put that data into Hospitally, including telling guests about it and getting any consent the law requires. We process guest information on the hotel's behalf and only on its instructions.
Acceptable use
Don't:
- break the law, or use Hospitally to harm, harass or deceive anyone, guests included;
- try to reach another hotel's data, get around access controls, or probe or test the service's security without our written permission;
- overload, disrupt or reverse engineer the service, or scrape it with automated tools except through an API we provide;
- upload malware, or content you don't have the right to use;
- resell the service or copy it to build a competing product.
We may suspend access that breaks these rules or puts the service or other hotels at risk. Where we reasonably can, we'll tell you first.
Integrations
Hospitally can connect to systems your hotel uses, such as a brand PMS, a channel manager or Google Places. Those systems are run by other companies under their own terms. We aren't responsible for them, and a connection may stop working if they change. Reservations, rates and availability you send through an integration are your hotel's commitments to its guests.
Preview features
Some features are marked as a preview or demo, including the Hospitally Connect API described on our developers page. They may change or stop working, and aren't covered by any service commitment. The live demo uses fictional guests. Don't rely on it for real operations.
Plans and fees
Hospitally is free to use today. Some features, such as floor plan import, are available on the Pro plan. Before we charge for anything, we'll tell you the price and terms in advance, and you'll choose whether to pay. Nothing you use for free now will start costing money without your agreement.
Ending
You can stop using Hospitally at any time and ask us to delete your account or, as general manager, your hotel. We may end or suspend access for a serious or repeated breach of these terms, or if we stop offering the service. If we stop offering it, we'll give you at least 30 days' notice and a way to export your hotel's data.
Disclaimers
We work hard to keep Hospitally running and accurate, but it is provided "as is" and "as available". To the extent the law allows, we disclaim all warranties, including merchantability, fitness for a particular purpose and non-infringement, and we don't promise the service will be uninterrupted or error-free. Forecasts, room suggestions, floor plans read from files and other automated results may be wrong. Check them before acting on them.
Liability
To the extent the law allows, Hospitally isn't liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, bookings or data. Our total liability for any claim about the service is limited to the greater of the amount you paid us in the 12 months before the claim and US$100. Nothing in these terms limits liability that can't be limited by law.
You'll cover us against claims from others that arise from the data you put into Hospitally or from your breach of these terms.
Changes
We may update these terms as Hospitally grows. We'll change the date at the top. If a change is significant, we'll tell you by email or in the app at least 30 days before it takes effect. If you keep using Hospitally after that, the new terms apply. If you don't agree, you can stop using it.
